. � . � . ORDINANC� N0. � �l � NltC�OFII.MED ORDINANCE AMENDING SUBDiVISION ORDINANCE REGARDING MINOR PLATS BE IT ORDAINED BY THE COUNCIL OF THE CITY Or DECATUR, ILLINOIS : Section l . That Ordinance No . 80-56 , known as the Subdivision Ordinance of the City of Decatur, be, and the same is hereby, modified and amended at Sections 4-1, 5-7 , 6-7 and 9-1 thereof so that as so amended and :nodified said sections provide as follows : 4-1 . A filing and engineering review fee shall be paid to the City Treasurer at the time a preliminary plat is filed with the Department of Community Development , or at the time a final plat is so filed if there was no preliminary plat , according to the following fee schedule: Subdivision . . . . . . . $100 . 00 Minor Subdivision . . . . . 50 . 00 5-7 . Action to approve or deny preliminary plats shal_1 be taken by thz City Council, provided that action to approve or deny preliminary plats of minor subdivisions may be taken by the Dir�ctor of Community Devalopment with the concurrence of the Director of Public Works . b-7 . Action to approve or deny final plats shall be taken by tY:e City Council, provided that action to approve or deny f=na1 plats of miror subdivisions may be taken by the Director of Community Devel.opment with the concurrence of �he Director of Public Works . 9-l. Whenever the tr_act to be subdivided is of such unusual size, shape or topography, or is aurrounded by such dev�lopment cr unusual conditions that the strict application of the requirements cantained in this Ordinance would result in real difficulties or substartial hardship , tr.e Council may vary or modify such requirements as to a�-�y subdivision, or the Director of Community Develop;nent , with �he concurrence of the Dir�ctor of Public Works , may vary or modify such requirements as to any minor subdiv�sion, so that the subdi�ider may
