MICROftIMED <br /> ORDINANCE N0 : � (Q— � � <br /> ORDINANCE AMENDING CITY CODE <br /> CHAPTER 5 - DEFENSE AND INDEMNITY <br /> OF OFFICERS , EMPLOYEES AND OTHERS <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR , ILLINOIS : <br /> Section 1 . That the City Code be , and it is her�sby , amended at <br /> Section 19 of Chapter 5 thereof so that said section as so amended <br /> shall provide as follows : <br /> 19 . Except for wilful and wanton conduct or <br /> criminal misconduct , if any claim or action is <br /> instituted against an officer , employee or member <br /> of a board , commission or committee of the City , or <br /> a former officer , employee or member , based upon an <br /> injury allegedly arising out of an act or omission <br /> occurring within the performance of the duties on <br /> behalf of the City of such officer , employee or <br /> member , provided notice of such claim or action is <br /> given to the City Clerk within a reasonable time , <br /> at its option , the City shall do or cause to be <br /> done , one or more of the following : <br /> a ) Appear and defend against said claim; <br /> b ) Indemnify such officer , employee or member for <br /> the cost and expense of defending against such <br /> � claim or action; <br /> c ) Pay any judgment , or indemnify such employee <br /> or member for any judgment , based on such claim <br /> or action ; or , <br /> d ) Pay , or so indemnify for , the compromise or <br /> settlement of such claim or action . <br /> Section 2 . That the City Clerk be , and she is hereby , authorized <br /> and directed to cause the amendatory provisions hereof to be <br /> appropriately set out in said Code and the same to be published in <br /> pamphlet form. <br /> / � <br /> PRESENTED , PASSED , APPROVED and RECO�'�D this 24th day of <br /> February , 1986 .
