obligation alleged in said notice not to have been performed or <br /> observed, in the name and stead of the Issuer with full power to <br /> do any and all things and acts to the same extent that the Issuer <br /> could do in order to remedy such default. <br /> SALE OF THE BONDS; EXECUTION OF BOND PURCHASE AGREEMENT <br /> Section 12. The sale of the Bonds (the execution and <br /> issuance of which is authorized pursuant to Section 3 hereof) to <br /> the Purchaser at a price equal to the aggregate principal sum <br /> thereof and payment therefor pursuant to the Bond Purchase <br /> Agreement is hereby in all respects authorized, approved and <br /> confirmed. The Bond Purchase Agreement in substantially the form <br /> which has been presented to this City Council is hereby approved. <br /> The Mayor is hereby authorized and directed to execute <br /> the Bond Purchase Agreement for and on behalf of the Issuer, and <br /> the City Clerk is hereby authorized to attest the same and to <br /> affix thereto the corporate seal of the Issuer, including with <br /> such changes therein as the officers of the Issuer executing it <br /> shall approve, their approval thereof being conclusive of the <br /> Issuer ' s approval of any such changes therein from the form <br /> thereof now before the City Council. <br /> PERFORMANCE PROVISIONS <br /> Section 13.
