McQueen, Planner <br /> Dept . of Community Development <br /> SUBJECT: Setback variance for Zion Tabernacle Church, <br /> 637 West Marietta Street <br /> A petition submitted by Zion Tabernacle Church, 637 West Marietta <br /> Street , requesting reconsideration of recent action taken by the <br /> Zoning Board of •Appeals regarding a setback variance is scheduled <br /> for review and action by the City Council on Monday, July 15 , s <br /> 1985 . The subject proposal, which involves an expansion of the <br /> existing church structure while leaving side yard setbacks of � <br /> three feet and eleven feet rather than the minimum required side : <br /> yard of forty feet , was denied by the Board at their regularly ; <br /> scheduled hearing held Thursday, June 13 , 1985 . The vate of the <br /> Board Was two ayes and three nays on a motion to approve the <br /> petition . � <br /> � <br /> In accordance with Section XXIII .D. of the Zoning Ordinance, any �! <br /> decision of the Zoning Board of Appeals decided by the ! <br /> aff irmative vote of less than five members of the BoaLd (total � <br /> ! <br /> Board membership is seven ) shall be subject to appeal to the City � <br /> Council by the party aggrieved if such request for an appeal is � <br /> filed with the City Clerk within ten (10 ) days after the decision f <br /> of the Board is given. Zion Tabernacle Church has accordingly � <br /> filed the subject appeal petition within the designated time E <br /> frame to request review of their proposal by the City Council . 4 <br /> Enclosed with the Council packet is a copy of the subject � <br /> petition, plan, and minutes of the Zoning Board of Appeals ' <br /> hearing of June 13, 1985. The staff recommendation regarding the <br /> matter is included within said minutes .
