McQueen, Planner Dept . of Community Development SUBJECT: Setback variance for Zion Tabernacle Church, 637 West Marietta Street A petition submitted by Zion Tabernacle Church, 637 West Marietta Street , requesting reconsideration of recent action taken by the Zoning Board of •Appeals regarding a setback variance is scheduled for review and action by the City Council on Monday, July 15 , s 1985 . The subject proposal, which involves an expansion of the existing church structure while leaving side yard setbacks of � three feet and eleven feet rather than the minimum required side : yard of forty feet , was denied by the Board at their regularly ; scheduled hearing held Thursday, June 13 , 1985 . The vate of the Board Was two ayes and three nays on a motion to approve the petition . � � In accordance with Section XXIII .D. of the Zoning Ordinance, any �! decision of the Zoning Board of Appeals decided by the ! aff irmative vote of less than five members of the BoaLd (total � ! Board membership is seven ) shall be subject to appeal to the City � Council by the party aggrieved if such request for an appeal is � filed with the City Clerk within ten (10 ) days after the decision f of the Board is given. Zion Tabernacle Church has accordingly � filed the subject appeal petition within the designated time E frame to request review of their proposal by the City Council . 4 Enclosed with the Council packet is a copy of the subject � petition, plan, and minutes of the Zoning Board of Appeals ' hearing of June 13, 1985. The staff recommendation regarding the matter is included within said minutes . An ordinance reversing the decision of the Board and approving the petition has been ; prepared and submitted for action by the City Council. � i � � i • t
