Code thereby causing an_y interest pa_yable on the Bonds to <br /> be includable in the gross income of any hold.er under the <br /> Code, shall constitute an Event of Taxability. <br /> "Executive" means the Mayor of the Issuer. <br /> "Indenture" means the Trust Indenture dated as of <br /> December 18 , 1984 , between the Issuer and the Trustee, <br /> including this Bond Legislation as a part thereof, and any <br /> permitted amendments or supplements thereto. <br /> "Interest Pavment Date" or "interest payment date" means, <br /> with respect to the Note and the Bond, the last day of each <br /> March, June, September and December commencing March 31 , <br /> 1985 , and continuing on the last day of each March, June, <br /> September and December thereafter. <br /> "Interest Rate for Advances" means the Prime Rate plus 3$ <br /> per ar_num. <br /> "Issuing Authority" means the City Council of the Issuer. <br /> "Lease" means the lease of the Project Site dated December <br /> , 1984, between Borrower, as lessee, and <br /> Archer-Daniels-Midland Company, a Delaware corporation. <br /> "Letter o� Credit" means the irrevocable Letter of Credit <br /> (to be dated the date on which the Bond is sold by the <br /> Issuer to the Original Purchaser thereof) of Joliet <br /> National Bank delivered to the Trustee as the same may from <br /> time to time be transferred, assigned or reissued in <br /> accordance with its ternls and any substitute letter of <br /> credit delivered to the Tr�astee pursuant to the Agreement. <br /> "Letter of Credzt Bank" means National Bank of Joliet, <br /> JoZiet, Illinois , its successors and assigns. <br /> "Letter of Credit Fund" means the Letter of Credit Fund <br /> created in the Indenture. <br /> "Mortgage" means the Mortgage and Security Agreement dated <br /> as of December 18 , 1984 , whereby the Borrower has granted <br /> to the Trustee, as security for payment of the Note and the <br /> Bond, a mortgage on and security interest in the Project <br /> and the Project Site, and any permitted amendments or <br /> supplements thereto. <br /> "Note" means the Promissory Note, in the form attached as <br /> Exhibit C to the Loan Agreement, issued by the Borrower to <br /> the Issuer concurrent with the delivery of the Loan <br /> AgreemPnt. <br /> 6 <br />
