, � . , . <br /> . . • , ��,•"V 3 <br /> ORDINANCE N0. � .- 3 3 <br /> ORDINANCE AMENDING CITY CODE <br /> BASIC REFUSE REMOVAL SERVICE <br /> iJHEREAS , it is vital to the public health, safety and <br /> welfare that refuse produced within the community be removed from <br /> the place of production to some place of disposal ; and , <br /> [JHEREAS , the safe , sanitary and environmentally sound <br /> disposal of all waste , including refuse , is within the <br /> jurisdiction of the State , along with the removal of industrial <br /> process waste and hazardous waste ; and , <br /> WHEREAS , on the other hand, the removal of refuse from <br /> places of production within the community is within the police <br /> power and public health protection duties of the City; and, <br /> WHEREAS , it is necessary that a safe , economical and <br /> efficient program of refuse removal within the City be provided <br /> for the protection of the health, safety and welfare of the <br /> public ; and , <br /> WHEREAS , it is also necessary to the safety of the pub2ic <br /> that heavy vehicular use and congestion on and in the streets , <br /> alleys and ways in the City be discouraged ; and , <br /> WHEREAS , it has been determined that said purposes will"'be <br /> better served by private enterprise through arrangement between <br /> respective refuse producers , or those responsible for the places <br /> whereat the same is produced, and persons , or entities engaged <br /> in providing refuse removal services , all under regulation, <br /> supervision and control of the City; and , <br /> WHEREAS , it is necessary for the operation thereof and the <br /> regulation, supervision and control by the City of such system of <br /> basic refuse removal service that those responsible for the <br /> removal of refuse be readily identifiable , and ambiguity or <br /> confusion as to the bearer of such responsibility in any given <br /> instance be reduced insofar as may be ; and , <br /> WHEREAS , for many years and up and until recent months the <br /> traditionally established routes and service areas wherein not <br /> nore than one person or entity provided removal service well <br /> served the health , safety, welfare and convenience of the <br /> residents of the City with minimal confusion and minimal <br /> intervention b� the ofiicers and employees of the City; and , <br />
