� / .� <br /> J ♦ <br /> • ��� <br /> ORDINANCE IVO. � —��-- <br /> AN ORDINANCE GRANTING A VARIATION <br /> WHEREAS, on March 8, 1984 , pursuant to notice as required <br /> by statute, the Decatur Zoning Board of Appeals held a public <br /> hearing upon the petition of ROBERT T. KILTON for a variation <br /> in the minimum side yard setback requirements under the Zoning <br /> Ordinance of the City of Decatur from 5 feet to 3 feet upon <br /> premises described as : <br /> Lot 231 of Windsor Village Fifth Addition as per Plat <br /> recorded in Book 1405 Page 48 of the Records in the <br /> Recorder' s Office of Macon County, Illinois; <br /> and, <br /> WHEREAS, after due consideration and upon a vote of less <br /> than five ( 5 ) members thereof, said Zoning Board of Appeals <br /> did deny the prayer of said petition and did refuse to vary the <br /> provisions of said Zoning Ordinance. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY �� <br /> OF DECATUR, ILLINOIS: ', <br /> Section 1. That the decis.ion of the Decatur Zoning Board I <br /> of Appeals upon the aforesaid petition be received, placed on <br /> file, and disapproved. <br /> Section 2. That the requested variation in the aforesaid <br /> minimum side yard setback requirements from 5 feet to 3 feet as <br /> requested by petitioner be, and the same is hereby, allowed, and <br /> the Building Inspector be, and he is hereby, authorized and <br /> directed to issue a building permit, provided that all other <br /> statutes, ordinances, rules and regulations with regard thereto <br /> are properly complied with, permitting construction of the <br /> improvement in said application proposed with minimum setback <br /> as in said application requested and in this ordinance rovided. <br /> � <br /> PRESENTED, PASSED, APPROVED AND RE�ORDED this `�. day of <br /> April, 1984 . <br /> �; <br /> MAYOR <br /> ATTEST: <br /> � <br /> ITY LER <br />
