�_-��� ����7��:�.�°� r. <br /> ORDINANCE NO. � — 7 � <br /> ORDINANCE AUTHORIZING SIGN OVER SIDEWALK <br /> - 545 NORTH BROADWAY - <br /> Yv'HEREAS, Section 6 of Chapter 39 of the City Code prohibits <br /> a building from extending over or across any street or sidewalk <br /> of the City eycept by special ordinance; and, <br /> WHEREAS, dds Computers, Inc. has petitioned the City <br /> to allow a sign to extend five feet over the sidewalk from <br /> its building located at 545 North Broadway as shown on the <br /> letter and drawing presented to the Council herewith; and, <br /> WHEREAS, Section 13 of Ordinance No. 82-32 , the Building <br /> Ordinance, requires that certain assurances of indemnity <br /> be provided to the City before a sign may be extended over <br /> a street or sidewalk; and, <br /> WHEREAS, the Council feels that such sign should be <br /> permitted on said building. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br /> CITY OF DECATUR, ILLINOIS: <br /> Section l. That the petition of dds Computers, Inc. <br /> rererred to above be, and the same is hereby, received, placed <br /> on file and approved. <br /> Section 2 . That upon the condition hereinafter set <br /> out and until further order of the Council, said petitioner <br /> be, and it is hereby, permitted and authorized to construct <br /> or cause to be constructed a sign to extend over the sidewalk <br /> from the building located at 545 North Broadway substa:ntially <br /> as indicated and shown on the letter and drawing presented <br /> to and approved by the Council . <br /> Section 3 . That said permission granted hereby be, <br /> and the same is hereby, expressly conditioned upon petitioner <br /> submitting to, and keeping in effect and on file with, the <br /> City Clerk either (1) a corporate surety bond in the sum <br /> of Thirty Thousand Dollars ($30 , 000) , as approved by the <br /> Legal Department, indemnifying the City against all loss, <br /> cost, damage or expense to person or property incurred or <br /> sustained by or recovered against the City by reason of the <br />
