� � �d v+'�%+htr;'"'� <br /> � ��Y 7� <br /> WHEREAS, Smith Barney, Harris Upha.m & Co. , Incorporated <br /> and other underwriters (the "Underwriters" ) have offered to purchase <br /> the Bonds at a price acceptable to the Municipality and the Hospital, <br /> and in order to provide for the issuance of the Bonds it is necessary <br /> f or the i�unicipality to authorize the execution of the fol.lowing des- <br /> cribed documents in substantially the forms before this meeting: <br /> (I.) A Second Supplemental Trust Indenture dated as of <br /> July 1, �983, between the Municipality and the Trustee, pertaining <br /> to the Refunding (the "Supplemental Indenture" ) ; <br /> (2) A Loan Agreement dated as of July 1, 1983, between <br /> the Municipality and the Hospital (the "Loan Agreement" ) ; and <br /> (3) A Bond Trust Indenture dated as of July 1, �983 be- <br /> tween the Municipality and American National Bank and Trust Company, <br /> as Bond Trustee (the "Bond Indenture") ; and <br /> (4) An Official Statement dated on or about July 20 , �983, <br /> to be used in connection with the sale of the Bonds (the "Official <br /> Statement") ; and <br /> (5) A proposed Purchase Contract to be dated on or about <br /> July 20 , 1983 , among the Municipality, the Hospital and the Under- <br /> writers (the "Purchase Contract") . <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br /> City of Decatur, Macon County, Illinois, as follows : <br /> Section 1. That the Municipality is a home rule unit <br /> under the provisions of the 1970 Constitution of Illinois, and as <br /> a home rule unit may, under the powers granted by Section 6(a) of <br /> Article VII thereof, "exercise any power and perform any function <br /> pertaining to its government and affairs .
