� , • ��,; . <br /> ORDINANCE IVO. 83-46 <br /> AN ORDINANCE providing for the issue of <br /> �12, 7b0,000 General Obligation Refunding <br /> Bonds , Series �983 , of the City of Decatur, <br /> Macon County, Illinois , and for the levy <br /> and collection of a direct annual tax <br /> sufficient to pay the principal and <br /> interest on said bonds. <br /> * � � <br /> WHEREAS, Section 6(a) of Article VII of the 1970 <br /> Constitution of the State of Illinois (the "Constitution" ) pro- <br /> vides that any municipality which has a population of rrore than <br /> 25,000 is a home rule unit; and <br /> WHEREAS, the official population of the City of Decatur, <br /> :�acon County, Illinois .(the "City") , as determined by the 1980 <br /> federal census is 94,081 ; and , ', <br /> WHEREAS, pursuant to the provisions of the Constitution, <br /> the City is a home rule unit and as such may exercise any power <br /> or perform any function pertaining to its governmer.t and affairs , <br /> including, but not limited to, the power to tax and to incur <br /> debt; and <br /> WHEREAS, Section 6(d) of Article VII of the �onstitution <br /> grants constitutional authority for the City to incur debt payable <br /> f rom ad valorem property tax receipts :naturing within fort,y (40) <br /> years from the time it is incurred and without prior referendum <br /> approval ; and <br /> WHEREAS, on the 25th day of February , 1982, the Council <br /> of the City ( the "Council") adopted an ordinance determining <br /> the procedures to be foliowed in the borrowing of money for <br />
