II . . . . <br /> e . <br /> I <br />� <br /> (B) The Fourth Amendment Agreement is in <br /> due and proper form and has been duly and <br /> validly authorized on the part of the Authority <br /> by its Board and constitutes a valid , binding <br /> and enforceable agreement of the Authority in <br /> accordance with its terms . <br /> (C) That the payment of $1 ,059,000.OQ by the <br /> E Authority to the City has been duly and validly <br />� <br /> authorized on the part of the Authority by its <br /> Board. <br /> (D) That the Authority has full power and authority <br /> to purchase the real estate and such purchase will <br /> not violate any provision of the Statutes of the State <br /> of Illinois or ordinance or resolution of the Board of <br /> the Authority, or the provisions of any agreement or <br /> other .instrument to which the Authority is a party or <br /> by which it or its property is bound or affected. <br /> (c) Possession: Possession of the real estate shall be given by the City <br />� to the Authority at the closing. <br /> 6. Time Limitation. The Commitment and undertaking of the City in this <br /> Fourth Amendment Agreement is subject to the condition that on or before June 30, <br /> 1983, the Authority shall have obtained the recertification described above, the <br />� revenue bonds described in paragraph 3(a) shall have been sold , the proceeds thereof <br /> I <br /> paid to the Authority and the Closing described in paragraph 5 shall have taken <br /> place.
