M1CR0�1LMED <br /> ' ORDINANCE NO. �a -cl W <br /> , AN ORDINANCE REZONING PROPERTY <br /> B-3 PLANNED SHOPPING CENTER DISTRICT <br /> WHEREAS , on the Sth day of August , 1982 , upon due notice, the <br /> Decatur City Plan Co�ission held a public hearing upon the petition <br /> of The First National Bank of Decatur, as Trustee under Trust No. <br /> 3335 to rezone premises described as : . <br /> Part of the Southwest One quarter (4) of the South- <br /> east quarter (4) of Section Twenty-Six (26) , Town- � <br /> ship Seventeen (17) North, Range Two (2) East of <br /> the 3rd P .M. , described as follows : " � <br /> Beginning at the Southwest corner of the Southwest <br /> Quarter (�) of the Southeast Quarter (4) of said <br /> Section 26 , thence North 430 feet; thence East 660 <br /> feet; thence North 458 .5 feet; thence East 652 . 2 <br /> feet; thence South 892 . 2 feet; thence West 1, 312 . 2 <br /> feet to the place of beginning, except that part <br /> thereof lying north and west of Spring Creek, : <br /> situated in Macon County, Illinois , <br /> from R-1 SINGLE FAMILY RESIDENCE DISTRICT to B-3 PLANNED SHOPPING � <br /> CENTER DISTRICT; and, - <br /> WHEREAS , the Decatur City Plan Co�mission recommended that <br /> the prayer of said petition be granted. ' <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: ; <br /> Section 1 . That the recommendation of the Decatur City Plan ' <br /> Commission be, and the same is hereby, received, placed on file and <br /> approved. <br /> Section 2. That upon the condition that said premises are <br /> developed only in accordance with the site plan thereof attached <br /> hereto, marked Exhibit A and hereby made a part hereof, and upon <br /> the further condition that petitioner obtain a permit to place I <br /> landfill on said premises from the Division of Water Resources of <br /> the Department of Transportation of the State of Illinois , said I <br /> prenises be , and they are hereby, rezoned from R-1 SINGLE FAMILY ' <br /> RESIDENCE DISTRICT to B-3 PLANNED SHOPPING CENTER DISTRICT� <br /> Section 3 . That the Districts hereinabove mentioned are those <br /> districts set forth and defined in Ordinance No. 3512 of the City <br /> of Decatur, Illinois , co�only known as the Zoning Ordinance and <br /> all the provisions , regulations , restrictions and requirements <br /> therein set forth shall apply to the premises above described herein. <br />
