. � . . . . , . �; , , � �1CROf1L�ED ORDINANCE NO. ��-�j 5 ORDINANCE AUTHORIZING LAND ACQUISITION ��IATER TREATMENT SLUDGE DISPOSAL CITY PR:OJECT 8011 WHEREAS , the City of Decatur , Illinois , owns and operates a water works for the provision of the public water supply for said City and its environs ; and, ��THEREAS , the Council of said City has adopted and approved a plan for the disposal of lime sludge generated by the treatment and processing of raw water before distribution of treated water through the system of said water works ; and, WHEREAS , it is necessary and desirable that suitable lands in reasonable proximity to the North Water Treatment Plant of sa�d public works be acquired for said public purpose; and, WHEREAS , the premises described in Exhibit A hereto attached and hereby made a part hereof, are in near proximity of said treatment plant and are suitable for the purpose of such sludge disposal; and, WHEREAS , it is necessary that said lands be acquired for the purpose aforesaid. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS : Section 1. That it be and it is hereby determined to be ' necessary and desirable that the City, in order to carry out the disposal of sludge generated by the treatm.ent of water for the public water supply of the City, acquire title to the real property described in Exhibit A hereto attached and hereby made a part hereof. Section 2 . That it be and it is hereby determined that the aforesaid real property and the acquisition thereof is necessary for a public use and purpose . Section 3 . That the City Manager and Corporation Counsel, jointly and severally, be, and they are hereby authorized and directed to cause said real property to be acq_uired on behalf of the City, and in the event the same is not able to be acquired by agree�ent with the owners thereof upon the compensation or consideration to be paid or furnished for the same, or in the event title thereto is defective , then title to and possession of said real property shall be acquired by and for the City by the exercise of condemnation under the Eminent Domain law of the State of Illinois .
