� / '� � _ • <br /> , • � ��/Z,7w. <br /> ��rUR�� <br /> ORDINANCE NO. ��-�3 � <br /> ORDINANCE AMENDING ZONING ORDINANCE <br /> - HISTORIC NEIGHBORHOOD USES - <br /> WHEREAS, on the lst day of July, 1982 , upon due notice, <br /> the Decatur City Plan Commission held a public hearing upon <br /> the Petition of the Director of the Department of Community <br /> Development to amend the Zoning Ordinance so as to provide for- <br /> Special Uses in the Decatur Historic District; and <br /> WHEREAS, the Decatur City Plan Commission recommended that <br /> the prayer of said petition be granted. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the recommendation of the Decatur City <br /> Plan Commission be, and the same is hereby, received, placed <br /> on file and approved. <br /> Section 2 . That Ordinance No. 3512 , as amended, the same <br /> being the Zoning Ordinance of the City of Decatur, be, and the <br /> same is hereby, amended at Section II thereof by adding thereto <br /> paragraph 76 so that as so amended said Section II shall provide <br /> at paragraph 76 as follows: - <br /> 76 . Historic Heighborhood Use: A use of land in <br /> the Decatur Historic District as established <br /> by Ordinance No. 78-159 that, �aith appropriate <br /> controls and under specific conditions, is <br /> consistent with and preserves the essential <br /> character and nature of the surrounding <br /> neighborhood, but which is not listed herein <br /> as a permitted use in the particular zoning <br /> district applicable to and underlying such land. <br /> Section 3. That said Zoning Ordinance be, and the same is <br /> hereby, further amended at Section XXI thereof by adding thereto <br /> paragraph A.l . (W) so that as so amended said paragraph A. l. (W) <br /> provides as follows : <br /> A.l . (W) Historic Neighborhood Use: Historic <br /> Neighborhood use, but only for a specific use <br /> and only if the proposed exterior appearance <br /> of the building as shown by plans and drawings <br /> submitted by the petitioner preserves the <br /> historic and architectural character of such <br /> building. Such a permit may not be issued by <br /> the Council sooner than 30 days after said <br />
