Mrs. Jazayeri said that they are only asking for a little more parking. She said she agreed that the children need a sidewalk to walk to school, but they would need help from the city to provide that. Mr. Cusick asked the petitioner if she would be willing to forego rezoning this property and apply to the Zoning Board of Appeals for a Special Use Permit? She said that would be agreeable if rezoning was not necessary. Staff recommendations: Mr_ Rhodes stated that the parcel sought to be rezoned is situated at the northeast corner of Brush College Road and Park Lane. The easterly portion of the tract is a rather deep and wide open drainage way. The commercial structure located on the lots immediatel� to � the north does not have adequate off-street parking. Topographic features in the immediate vicinity (west, east and south) mi.nimize any adverse effect the proposed use might have on the nearby properties. The size, shape and location of the property is such that an R-3 use (single family residence) is not likely to be established. The proposed B-2 zoning is compatible with the existing zoning and the goals and objectives of the City' s Comprehensive Plan. The staff recommends approval of the proposed B-2 zoning for Lot 50 and that part of Lot 51 lying North of Park Lane. It was moved and seconded (Overturf/Wilmeth) that Ca1.No. 81-40 be recommended to Council for denial.
