T _ . , �ICROfILMm <br /> . .� " . <br /> ORD INANCE NO.�a 5 <br /> - r <br /> ORDINANCE AMENDING ZONING ORDINANCE <br /> - AUTOMOBILE STORAGE YARDS- <br /> WHEREAS, on the 2nd day of April, 1981, upon due notice, <br /> the Decatur City Plan Commission held a public hearing upon <br /> the petition of the Director of the Department of Community <br /> Development to amend the Zoning Ordinance so as to remove <br /> automotive storage yards as a land use from the M-1 zoning <br /> district to the M-2 zoning district; and, <br /> WHEREAS , the Decatur City Plan Commission recommended that <br /> the prayer of said petition be granted. <br /> NOW, THEREFORE , BE IT ORDAINED BY THE COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the recommendation of the Decatur City <br /> Plan Commission be, and the same is hereby, received, placed <br /> on file and approved. <br /> Section 2 . That Ordinance No. 3512; as amended, the same <br /> being the Zoning Ordinance of the City of Decatur, be, and <br /> the same is hereby, amended at Section II thereof by adding <br /> thereto paragraph 73 so that as so amended said Section II <br /> shall provide at paragraph 73 as follows : <br /> 73 • Automobile Storage Yards: A tract of land used <br /> primarily for the collection, accumulation or <br /> storage of damaged, towed or abandoned automotive <br /> equipment including but not limited to automobiles, <br /> trucks , buses , motorcycles and other motor vehicles <br /> or parts thereof, but excluding businesses such as <br /> public garages, filling stations , or dealerships <br /> which temporarily store automotive equipment <br /> in the course of the repair or sale of the same and for <br /> which such storage is secondary or incidental to the <br /> primary purposes of such business . <br /> Section 2 . That said Zoning Ordinance be, and the same <br /> is hereby, further amended at Section XV thereof by amending <br /> paragraph (B) ( 3) thereof so that as so amended said paragraph <br /> (B) ( 3) provides as follows : <br /> 3 • Carting, express , hauling, or storage yard, <br /> except an automotive storage yard as herein defined. <br /> Section 3 . That said Zoning Ordinance be, and the same is <br /> hereby, further amended at Section XVI thereof by amending <br /> paragraph (B) (6) thereof so that as so amended said paragraph <br /> (B) (6) provides as follows : <br />
