<br /> and wa�rant unto the ILLINOIS POWER COMPANY, an Illinois Corporation, (hereinafter the Grantee), its successors and
<br /> ossigns, the perpetual right and easement to erect, reconstruct, operate, potrol, maintain, renew and remove elect�ic
<br /> trensmission and distribution lines, steel towers, poles, footings, anchors, stubs, brace poles, guys, cross arms, in-
<br /> sulntors; conductors, ground wires, cobles a�d counterpoises, and other equipment appurtenant thereto, includinq signe)
<br /> and telepho�e lines and equipment, for the transmission and distribution of electric energy through, over and across
<br /> certoin londs owned by Grontor in the County of—Macon , $tate of Illinois, ond described es follows:
<br /> A strip of land 40 ' in width over and across and through
<br /> a tract of land described as : Lot 2 of Assessor' s Subdivision
<br /> _ of the South 2 of Lot 2 of the Northwest 4 vf Section 18 ,
<br /> Township 16 North, Range 3 East of the 3rd P .M. as per plat �
<br /> recorded in Book 22 page 43 of the records in the Recorder' s
<br /> Office of Macon County, Illinois , all except a strip of land
<br /> 36. 5 ' in width of the entire West side thereof and except
<br /> a strip of land 20 ' in width off the entire South side thereof;
<br /> the center line of said strip of land is described as extend-
<br /> ing through a point of beginning on the East line of said
<br /> tract at a point 21' South of the Northeast corner thereof;
<br /> thence extending Westerly through a point on the East line
<br /> of 27th Street 35 ' South of the North line of the Southwest 4
<br /> of the Northwest 4 of Section 18-16-3 East of the 3rd P.M.
<br /> including the right to cleor said easement of obstacles and obstructions. Grantor further grants the right to use for
<br /> said purposes the adjacent roads, streets and elleys and to usa reasonable workinq space adjacent to said easement
<br /> during erection, reconstruction, operotion, meintenance, renewal or removol of soid electric lines, and the right of in-
<br /> gress to and eoress from said easement for the purposes aforescid overexistingrocdwoys or over o route designated Ly
<br /> Grantor and the riqht to trim, sproy with a toxic substance, or fell such tree.s, branches, shrubbery and bushes and to
<br /> remove such other obstacles as may interfere with the safe, proper and expeditious use of said eesement for any of
<br /> the eforesaid purposes under vorying,conditions of operation without furthe� payment iherefor exeept as hereinafter
<br /> provided.
<br /> Grantee shell repair any damoqe to property of Grantor or pay any substantia) damages which may be caused to
<br /> property of Grentor in the p�ocess of exercisinq ony of the riQhts herein grented; soid damages if not mutually ogreed
<br /> upon shall be ascertained by three disinterested pe�sons, one of whom shall be selected by Grantor and one by Cx an-
<br /> tee, their heirs, successors, ossigns, or lessees, respectively, cnd the third by the two so selected. The damages
<br /> determined by such persons or a majority of them shall be co�clusive and bindinQ on the perties hereto a�xl Grantee
<br /> snall thereupon pcy the omount so determined.
<br /> vrontee aqrees to poy any and all taxes ond essessments which mey be levied or assessed upon all'of its
<br /> said facilities placed upon said pre mises by Grantee.
<br /> Grantee further agrees that it will protect, indemnify end save harmless Grantor from al) loss of o� domoge to
<br /> the property of Grantor a�d from and aqainst any and all claims, demands, suits, ectiens, judgments and recoveries,
<br /> includinc court costs and attorneys' fees, directly or indi�ectly resultinq from the loss of or damage to the property of
<br /> any other person, firm or corporation and injury to or death of any persons whomsoever, including employees of Gran-
<br /> tor, in any monner arising or orowinq out of the erection, maintenance, repair, relocotion, renewal, use, operation, or
<br /> removel of said tronsmission line or lines, or any of them, except where such loss, damaQe, injury ar death is shown
<br /> to hove been ceused by the negligence of Grantor.
