� - �uic�oFiu�� <br /> �.. _ <br /> ORDINANCE NO. 81- J � <br /> ORDINANCE AUTHORIZING LAND ACQUISITION <br /> DECATUR NEIGHBORHOOD PRESERVATION DISTRICT <br /> WHEREAS, the City Council of the City of Decatur has heretofore by Resolution <br /> No, R78-15 designated a Decatur Neighborhood Preservation District; and, <br /> WHEREAS , the following described land is within said Neighborhood Preservation <br /> District and is vacant and unimproved; and, <br /> WHEREAS , it is necessary for the rehabilitation of said Neighborhood Preserva- <br /> tion District that said land be acquired by the City of Decatur so as to return the <br /> land to marketable status and thus more able to bear its fair share of the tax burden. <br /> 1 <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1 . That it be, and it is hereby, determined to be necessary and <br /> desirable that the City of Decatur, in order to further the rehabilitation of said <br /> Decatur Neighborhood Preservation District, acquire title and possession of the <br /> real property which is described on Exhibit X attached to this Ordinance and which <br /> real property is situated in said Neighborhood Preservation District and within the <br /> County of Macon, Illinois . <br /> Section 2 . That it be, and it is hereby, determined that the acquisition of <br /> the aforesaid real property is necessary for a public use . <br /> Section 3 . That the City Manager be, and he is hereby, authorized to cause <br /> said real property to be acquired on behalf of the City, and that in the event the <br /> same is not able to be acquired by agreement with the owner thereof upon the <br /> compensation to be paid therefore, or in the event title to said property is defective, <br /> then title to and possession of said real property shall be acquired by and for the <br /> City by the exercise of condemnation under the Eminent Domain Law of the State of <br /> Illinois . <br /> Section 4.
