„ <br /> � � �;��;�::���LMED, <br /> ORDINANCE NO.�- O � <br /> ORDINANCE AUTHORIZING LAND ACQUISITION <br /> RIVERVIEW FZOOD PROTECTION PROJECT <br /> WHEREAS, the Council by Resolution 80-73, adopted May <br /> 12 , 1980 , approved and adopted plans and specifications for <br /> providing flood protection to premises on West Riverview and <br /> West Sunset Avenues west of South Summit Avenue in the City <br /> near the flood plain of the Sangamon River and has authorized <br /> construction of such public improvement designated City <br /> Project 7916; and, <br /> WHEREAS, the Council subsequently approved and adopted <br /> certain modifications to said plans and specifications; and, <br /> WHEREAS, it is necessary that certain lands and rights <br /> in lands be acquired to construct said improvement ar.d appur- <br /> tenants thereto, either by voluntary agreement or by the <br /> exercise of the power of eminent domain as provided by law. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS : <br /> Section 1 . That it be, and it is hereby, determined to <br /> be necessary and desirable that the City in order to carry <br /> out and construct the flood protection public improvement <br /> as authorized and approved as aforesaid acquire title to, or <br /> rights therein sufficient to construct, maintain and operate <br /> surface water drains on, over, in and upon the real property <br /> situated in the City and in the County �of Macon, Illinois, <br /> identified and described in each of the separate descriptions <br /> attached hereto and hereby made a part hereof as if fully <br /> set out herein. <br /> Section 2 . That it be, and it is hereby, determined <br /> that the aforesaid real property and the acquisition thereof <br /> is necessary for a pu'alic use and purpose. <br /> Section 3 . That the City Manager and Corporation Counsel , <br /> jointly and severally, be, and they are hereby authorized and <br /> directed to cause said real property to be acquired on behalf <br /> of the City, and in the event the same is not able to be ac- <br /> quired by agreement with the owners thereof upon the compensa- <br /> tion or consideration to be paid or furnished for the same, or <br />
