ORDINANCE N0. � � -� OR.DINANCE VACATING A PORTION OF A STREET -WEST WAGGONER STREET- WHEREAS, a petition has been received from Decatur Housing Authority and others, being the owners of all property abutting thereon, requesting vacation of a portion of that certain street in the City of Decatur, Illinois, commonly known as West Waggoner Street, said portion of said street being more particularly described as : All that portion of West Waggoner Street lying between Lots Thirteen (13) and Fourteen (I4) in Block One of L. Towl ' s Addition to Decatur in the Southwest 4 of the Northwest 4 of Section 10 , Township 16 North, Range 2 East of the 3rd P.M. , Macon County, I1linois on the North and Lots Eleven (11) and �aelve (12) in Block Two of L. Towl 's Addition to Decatur on the South, situated in Macon County, Illinois; and, WHEREAS, the Decatur City P1an Commission held a public hearing upon said petition on June 5, 1980 , and did there� after recommend to the Council that the prayer of said petition be granted and said portion of said street be vacated as re- quested; and, WHEREAS, said portion of said street is no longer useful to the public or to the City or to the owners of property abutting thereon and the public interest will be subserved by ��acating said portxon of said street and the public will be relieved from any further burden or responsibility for opening, improving or maintaining said portion of said street; and, WHEREAS, by the Cooperation Agreement between said Decatur Housing Authority and the City of Decatur, approved by the Council by Resolution No. R2829 on May 7, 1973, it was agreed that compensation from the Authority for any benefit which might accrue to it by reason of the vacation of a street would be waived. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1 . That the above described portion of said West Waggoner Street be, and the same is hereby, vacated as a public street upon the exceptions and conditions hereinafter provided inasmuch as the same is no lon er re i qu red for ublic use an . . g P d the public interest will be subservec� b such vacation said .
