� � ` ' . ° . . �'�� Y11� � , ORDINANCE NO . b—1 O ORDINA�'VCE GRAIVTING CONDITIONAL AND LIMITED VARIANCE OF MINIMUM PARKING SPACE REGULATIONS ' WHEREAS, Decatur Housing Authority, is developing the premises in the City of Decatur, Illinois , described on Exhibit A attached hereto and hereby made a part hereof, and said Decatur Housing Authority proposes to construct thereon certain improvements to be used as housing for elderly families of low income; and, WHEREAS , said Decatur Housing Authority has requested that the parking and loading requirements of the City be varied by reducing the minimum number of required motor vehicle parking spaces to be constructed and maintained on said site appurtenant to said use to 50 percent of that number which would otherwise be required by said regulations in the R-6 Multiple Family District; and, Tr1HEREAS , after notice as provided by law and ordinance, the Zoning Board of Appeals on December 11 , 1980 , held a public hearing upon such request and did report and recommend that the same be granted and said regulations be varied as so limited and conditioned. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS : Section 1 . That the report and recommendation of the Decatur Zoning Board of Appeals be, and the same is hereby, received, placed on file and approved. Section 2 . That subject to the limitations and conditions hereinafter set out, the parking and loading regulations of the City be, and they are hereby, as to said premises varied by reducing the minimum number of motor vehicle parking spaces re- quired to 50 percent of that number which would otherwise be required in the R-6 Multiple Family District. Section 3 . That �the variance herein granted be , and the same is hereby, limited and conditioned to obtain and remain in force only so long as the use of said premises is restricted so that not less than three-fourths of the dwelling units therein are limited to housing for elderly families of low income as the same is defined in Ordinance No. 35I2, as amended, the same being the Zoning Ordinance, and said variance shall expire automatically if such use is discontinued or another use is implemented on said premises .
