� ,.. � � <br /> `� l�_ � �1�.�'�'a�$� s����, ss. �,r,"�'. , <br /> . � . . <br /> ' ' Th�t This Inttrument IAlsi Filed For C�� <br /> ' ' �''`�'�°' Rrcord At 11:30 AM <br /> s'�$� o� a�a <br /> �� <br /> ¢�'� NOV 19 1990 <br /> ORDINANCE NO. ,� G _ /3 D � <br /> �aacord.d in eook�Z�e�- <br /> ORDIN_�IVCE VACATING PORTION OF STREET ��.�` '/� <br /> , EAST WOOD STREET <br /> � .00 chg Recarder or oeeds <br /> WHEREAS, certain surveys have from time to time indicated <br /> that the south wall of the seven story building on the north <br /> side of the 200 Block of East Wood Street commonly now known <br /> as the Hotel Orlando was constructed so as to encroach upon <br /> street right of way approximately . 50 of a foot extending from <br /> the east line of South Water Street to the west line of <br /> South State Street; and, <br /> WHEREAS , such possible encroachment has existed <br /> continuously for more than sixty years last past and has not <br /> interfered with the use of said portion of East Wood Street by the <br /> public as a public street; and, <br /> WHEREAS, it is currently proposed and planned to <br /> extensively remodel and rehabilitate said hotel structure and <br /> such would be in the public interest and benefit of the <br /> of the community; and, ' <br /> WHEREAS , it appears to be an appropriate time to set at �I <br /> rest the question of such encroachment and to clear any defect ', <br /> in title to such building by reason thereof and that the piablic 'I <br /> interest will be subserved thereby; and, <br /> WHEREAS, said portion of said street is no longer useful <br /> to the public or to the City or to the owners of property abutting <br /> thereon and the public interest will be subserved by vacating <br /> said portion of said street and the public will be relieved from <br /> any further burden or responsibility for opening, improving or <br /> maintaining said portion of said street. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS : <br /> Section l. That the portion of East Wood Street in the City <br /> of Decatur, Illinois, underlying a portion of the building <br /> aforesaid, be, and the same is hereby, vacated as a public street <br /> or way, inasmuch as the same is no longer useful to or required <br /> by the public for public use and the public interest will be <br /> subserved by such vacation, said portion of said street being <br /> shown upon the plat thereof hereto attached and being described as : <br /> g�a�2�J�� �:n�F 9�8 <br />
