i. <br /> . , • �I(�tOFiLMED <br /> � ' ORDINANCE N0 . � ��� 3 <br /> ORDINANCE GRANTING CONDITIONAL <br /> AND LIMITED VARIANCE OF MINIMUM <br /> PARKING SPACE REGULATIONS <br /> WHEREAS, Contractors and Engineers, Inc . , is purchasing <br /> the premises in the City of Decatur, Illinois, described as : <br /> Part of the East 1/2 of the Northwest 1/4 of <br /> Section Three (3) , Township Sixteen (16) North, <br /> Range Two (2) East of the 3rd P.M. , more <br /> particularly described as follows : Beginning at <br /> a point on the East line of the Northwest 1/4 of <br /> Section 3, Township 16 North, Range 2 East, 522 feet <br /> North of the center of said Section 3; thence North 508 <br /> feet, more or less, to a point 96 rods South of the <br /> Northeast corner of the Northwest 1/4 of said Section 3; <br /> thence West 450 . 70 feet; thence South 509 .4 feet; thence <br /> East 453. 9 feet to the point of beginning; and <br /> excluding the South 171 feet thereof and except state <br /> route right-of-way. Situated in Macon County, Illinois; <br /> and said corporation proposes to construct thereon certain <br /> improvements to be used as housing for elderly families of low <br /> income; and, <br /> WHEREAS, said corporation has requested that the parking and <br /> loading requirements of the City be varied by reducing the minimum <br /> number of required motor vehicle parkir_g spaces to be construct�d <br /> and maintained on said site appurtenant to said use to 62a of <br /> that number which would otherwise be required by said regulations in <br /> the R-6 Multiple Family District; and, <br /> WHEREAS, said corporation has regresented and agreed tnat any <br /> such variance may be limited and conditioned and said limitations <br /> and conditions may be made a matter of record and a restriction upon <br /> and in the title of said premises for the benefit of the health, <br /> safety and welfare of the community to, among other things enhance <br /> the quiet, peace arid repose of the neighborhoad of said premises and <br /> lessen or prevent the congestion of motor vehicles upon its streets , <br /> and that the same may be enforced by the City in its own name by any <br /> appropriate action including injunction; and, <br /> WHEREAS , after notice as provided by law and ordinance, the <br /> Zoning Board of Appeals on September 11 , 1980 , held a public hearing <br /> upon such request and did report and recommend that the same be <br /> granted and said regulations be varied as so limited and conditioned. <br />
