J � '� ' �111CR��ED , , ORDINANCE N0. �� ORDINANCE AUTHORIZING DISPOSITION AND ACQUISITION OF CERTAIN PREMISES AND I THE RELEASE OF COVENANTS AS TO OTHERS PERSHING MOBILE HOMES SALES, INC. , WHEREAS, by reason of the frustration of the project and I! use permitted thereby, and upon the request of Pershing Mobile Home Sales, Inc. , the permittee thereunder, the special use permit ordained by Ordinance No. 6080 has been revoked and said ordinance ' repealed; and, WHEREAS, the consideration for the conveyance by said permittee to the City of premises in the City for the future extension and construction of Hays Avenue, as described in the proposed deed from the City to said corporation presented to the Council herewith, has failed and the same should be reconveyed to said corporation along with a release of certain convenants as to other premises , immediately west and adjacent to the premises aforesaid, the same being described in the proposed release presented to the Council herewith; and, ' WHEREAS , it is necessary and covenient for the public health, safety and welfare that certain premises of said corporation, . � including in part a portion of those premises heretofore conveyed by it to the City, be acquired by the City for the construction of Hays Avenue between the north end of North Charles Street and North Woodford Street, said premises being those described in the deed from said corporation to the City presented }o the Counci� herewith, and that the premises heretofore conveyed by said corporation to the City along the west line of said Charles Street be retained by the City for the future improvement of said street; and, WHEREAS, it has been agreed that in addition to the consideration by reasor. of the exchange of properties as herein set out further consideration in the amount of $10 , 200 shall be paid by the City to the corporation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the transaction, and each part thereof, and the agreement between the City and Pershing Mobile Home Sales, Inc. , described herein be, and the same are hereby, approved.
