The City Council rejected two previous petitions filed by the <br /> Petitioner to rezone the property. A petition to rezone to ft--6 was denied <br /> August 20, 1979, and a petition to rezone to 8-5 was denied November 5, 1979. <br /> 2. 'I�e requested rezoning to B-2 is for a less restrictive zoning <br /> than �eviously requested and would include the uses encompassed in R-fi and <br /> R-5 zones, both of which were previously rejected by the Councii. <br /> 3. The present Petition is an attempt to circumvent the City <br /> Counc�l's previous rulings and to develop the property for multi-family housing <br /> without pcoviding protection for the public health and safety contrary to the <br /> e�ress holdings oY both the Citp Plan Commission and the City Council. <br /> 4. The Petition does not comply with the requirements of the City <br /> Zoning Ordinance for petitions to amend the established zoning districts as set <br /> forth in Seetion XXVII of the Zoning Ordinance of the City of Decatvr. <br /> 5. The present Petition is an attempt to circumvent the provisions <br />
