Item Coversheet Page 1 of 1

Police Department
DATE: 9/2/2016
MEMO: 2016-74
TO: Honorable Mayor Moore Wolfe
FROM: Tim Gleason,City Manager
James Getz Jr.,Police Chief
Wendy Morthland,Corporation Counsel
Amy Waks,Assistant Corporation Counsel
SUBJECT:
Amendment to Chapter 34—Traffic and Parking
SUMMARY RECOMMENDATION: Staff requests that Council pass the proposed ordinance amendment regarding Chapter
34,Section 37 subsection M.
BACKGROUND: Chapter 34,Section 37 lists violations of Illinois state law for which a vehicle may be impounded. Since this
Ordinance was passed, the state has amended the Cannabis Control Act and the Drug Paraphernalia Control Act,reducing
possession of cannabis 10 grams or less to a civil violation(previously a Class B misdemeanor), possession of more than 10
grams to 30 grams a Class B misdemeanor and possession of drug paraphernalia while in possession of 10 grams or less of
cannabis a civil violation affecting Subsection M of the City's Chapter 34,Section 37. As the State has legislated that possession
of cannabis 10 grams or less is no longer a criminal offense as well as drug paraphernalia found while in possession of 10 grams or
less of cannabis,Staff recommends amending our impoundment ordinance to reflect the State's intent.
POTENTIAL OBJECTIONS: There are no known or expected objections.
STAFF REFERENCE: Amy Waks,Assistant Corporation Counsel,at 424-2807.
BUDGET/TIME IMPLICATIONS:
None.
ATTACHMENTS:
Description Type
Ordinance Amendin Cit Code Cha ter 34 Traffic and i,iilL,,
Par mg
Citv Code Chapter 34 Traffic and Parking Additions and l3arl.ur \(aterial
De eti
https:Udecatur.novusagenda.com/AgendaWeb/CoverSheet.aspx?ItemID=807 9/19/2016
