('�I�� <br /> ORDINANCE AMENDING R-5 RESIDENCE DEVELOPMENT PLAN <br /> - SOUTHERN HILLS <br /> WHEREAS, on the lst day of November, 1979, upon due <br /> notice, the Decatur City Plan Comanission held a public hearing <br /> � upon the petition of� Capital Associates Development Corporation <br /> to amend the R-5 Residence Development Plan approved by Ordinance <br /> No. 79-93 as to premises in the City of Decatur, Illinois, <br /> described as follows: <br /> The East ten acres of the West 15 acres of the South � <br /> 30 acres of the Southwest Quarter of the Southwest <br /> Quarter of Section 34 , Township 1 North, Range 2 <br /> East of the 3rd P.M. in the City of Decatur, Illinois. <br /> Excepting therefrom �the East 30 feet of the South 500 <br /> feet of the above-described paxcel; and, <br /> WHEREAS, said Decatur City Plan Commission did report <br /> its findings and did recommend that the modification of said <br /> R-5 Residence Development Plan as requested be authorized. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF <br /> THE CITY OF DECATUR, ILLINOIS: <br /> Section 1. That the report and reco�nendation of the <br /> Decatur City Plan Commission be, and the same is hereby, received, <br /> placed on f ile and approved. . <br /> Section 2 . That upon the conditions hereinafter mentioned, <br /> the aforesaid R-5 Residence Development Plan be, and the same is <br /> hereby, modified and amended and petitioner be, and it is hereby, <br /> authorized to develop the premises aforesaid in accordance with <br /> the plat and plans thereof attached hereto, marked Exhibits A, <br /> B, and C, hereby made a part hereof , and only in accordance <br /> with such plat and plans. <br /> Section 3 . That the authorization and modif ication <br /> provided for herein be, and the same is hereby, expressly conditioned <br /> as follows: <br /> a) That vehicular access over and across the existing <br /> private roadway, which is iocated within the proposed 50 foot <br /> right-of-way as shown on Exhibit A hereto, be kept open at all times <br /> to adjoining property owners during the construction period of the <br /> proposed new road. <br />, <br />
