. � . <br /> . �, . � <br /> . . �, • ; �fl�"M <br /> r • I <br /> ORDINANCE� NO. . --Oj� <br /> � <br /> AN ORDINANCE VACATING A PORTION OF A <br /> ROADWAY EASEMENT <br /> WHEREAS, a request has been received from Robert Keck for <br /> the vacation of a portion of a certain roadway easement of the City � <br /> � of Decatur described as follows:, <br /> The West 20 feet of the East 30 feet of the East <br /> Half of tHe North �Half of Lot 4 , Block 3 of Radio <br /> Towers Subdivision as �Ser plat recorded in Book 745 <br /> Page 244 of the records in the Recorder' s Office of <br /> �iacon County, Illinois; and, <br /> WHER�AS, Robert Keck is the owner of all property abutting on <br /> said portion of roadway easement; and� <br /> WHEREAS, said portion of said roadway easement is not improved <br /> and is no longer useful to the public or the City; and, <br /> WI�EREAS, the public interest will be subserved by vacating said <br /> po rtion of said roadway easement and the public will be relieved from <br /> any further burden or responsibility for opening, improving or main- <br /> taining said portion of said roadway easement. <br /> NOW, TI3EREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLIN�IS: <br /> Section 1. That the above described portion of roadway easement <br /> be, �nd the same is hereby, vacated as a public roadway easement <br /> effective and upon the exception and conditions hereinafter provided, <br /> inasmuch as the same is no longer required for public use and the <br /> public interest will be subserved by such vacation, said portion of <br /> said roadway easement being shown on the plat thereof hereto <br /> attached and hereby made a part hereof. <br /> Section 2. That the benefits which will accrue to the owners <br /> of abutting property by reason of the vacation aforesaid is determined <br /> to be, in the judgment of the Council, equal to the sum of SIX HUNDRED <br /> DOLLARS ($600 .00) . <br /> Section 3.
