. � . . �, . � . . �, • ; �fl�"M r • I ORDINANCE� NO. . --Oj� � AN ORDINANCE VACATING A PORTION OF A ROADWAY EASEMENT WHEREAS, a request has been received from Robert Keck for the vacation of a portion of a certain roadway easement of the City � � of Decatur described as follows:, The West 20 feet of the East 30 feet of the East Half of tHe North �Half of Lot 4 , Block 3 of Radio Towers Subdivision as �Ser plat recorded in Book 745 Page 244 of the records in the Recorder' s Office of �iacon County, Illinois; and, WHER�AS, Robert Keck is the owner of all property abutting on said portion of roadway easement; and� WHEREAS, said portion of said roadway easement is not improved and is no longer useful to the public or the City; and, WI�EREAS, the public interest will be subserved by vacating said po rtion of said roadway easement and the public will be relieved from any further burden or responsibility for opening, improving or main- taining said portion of said roadway easement. NOW, TI3EREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLIN�IS: Section 1. That the above described portion of roadway easement be, �nd the same is hereby, vacated as a public roadway easement effective and upon the exception and conditions hereinafter provided, inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation, said portion of said roadway easement being shown on the plat thereof hereto attached and hereby made a part hereof. Section 2. That the benefits which will accrue to the owners of abutting property by reason of the vacation aforesaid is determined to be, in the judgment of the Council, equal to the sum of SIX HUNDRED DOLLARS ($600 .00) .
