' � , ! <br /> . ��� <br /> ORDINANCE NO. � �o <br /> AN ORDIANNCE REZONING PROPERTY <br /> WHEREAS , on the 5th day of April , 1979 , upon due notice, the <br /> Decatur City Plan Commission held a public hearing upon the petitions <br /> of SAMUEL E. GIBBONS , JEANETTE E. GIBBONS and ROBERT W. KIMMONS <br /> and JUDITH I . KIMMONS to rezone premises described as : <br /> Lot One (1) of Horton' s Subdivision except the southerly <br /> 12 feet of even width across the entire southerly side of <br /> Lot 1 , as per P1at recorded in Book 958 , page 55 of the <br /> records in the Recorder' s Office of Macon County, Illinois , <br /> and also, beginning at the point of intersection of the <br /> Southeast corner of said Lot One (1) in Horton' s Subdivision, <br /> with the North right-of-way line of State Highway No. 105 , <br /> thence North 426 .46 feet along the East line of said Lot One <br /> (1) in Horton` s Subdivision, thence East 235 .11 feet, thence <br /> South 313. 07 feet to the North line of said State Highway 105 <br /> thence Southwesterly along and upon the North line of said <br /> highway 260 feet to the point of beginning, EXCEPT that <br /> part taken by the State of Illinois in Circuit Court case <br /> No. 74-ED-1 , <br /> from B-2 COMMERCI�'�1., I�ISTRICT and R-3 SINGLE FAMILY RESIDENCE <br /> DISTRICT to B-2 COMMERCIAL DISTRICT; and, <br /> WHEREAS, the Decatur City Plan Commission recommended that the <br /> prayer of said petition be granted. , <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section l . That the recommendation of the Decatur City Plan <br /> Commission be, and the same is hereby, received, placed on file <br /> and approved. <br /> Section 2 . That said described premises be, and they are <br /> hereby, rezoned from B-2 COMMERCIAL DISTRICT and R-3 SINGLE FAMILY <br /> RESIDENCE DISTRICT to B-2 COMMERCIAL DISTRICT. <br /> Section 3. That the Districts hereinabove mentioned are <br /> those districts set forth and defined in Ordinance No. 3512 of the <br /> City of Decatur, Illinois, commonly known as the Zoning Ordinance, <br /> and all the pro visions , regulations , restrictions and requirements <br /> therein set forth shall apply to the premises above described herein. <br />
