� � ��oF�ur►� <br /> ORDINANCE N0. ���- <br /> ORDINANCE AUTHORIZING LA�,'D ACQUISITION <br /> -DECATUR �IEIGHBORHOOD PRESERVATION DISTRICT- <br /> WHEREAS, the City Council of the City of Decatur has heretofore by Resolution <br /> No. R78-15 designated a Decatur Neighborhood Preservation District; and, <br /> WHE:tEAS, the following described land is within said Neighborhood Preservation <br /> District and is vacant and unimproved; and, <br /> WEiEREAS, it is necessary for the rehabilitation of said Neighborhood Preser�ation <br /> District that said land be acquired by the City of Decatur so as to return the land <br /> to marketable status and thus more able to bear its fair share of the tax burden. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: <br /> Section l. That it be, and it is hereby, determined to be necessary that the <br /> City of Decatur, in order to further the rehabilitation of said Decatur Neighborhood <br /> Preservation District, acquire title and possession of the following described real <br /> property situated in said Neighborhood Preservation District and within the County <br /> of Macon, Illinois: <br /> Lots 17 and 18 of Block 6 of Smith & Company Addition, as per plat <br /> recorded in Book T, Page 241 of the records in the Recorder's Office <br /> of Macon County, Illinois. <br /> Section 2. That it be, and it is hereby, determined that the public acquisition <br /> of the aforesaid real property is necessary for a public use. <br /> Section 3. That the City �Ianager be, and he is hereby, authorized to cause <br /> said real property to be acquired on behalf of the City, and that in the event the <br /> same is not able to be acquired by agreement with the owner thereof upon the com- <br /> pensation to be paid therefore, or in the event title to said property is defective, <br /> then title to and possession of said real property shall be acquired by and for the <br /> City by the exercise of condemnation under the Eminent Domain Law of the State of <br /> Illinois. <br /> Section 4.
