' � � <br /> ', • <br /> ` � � .� ������F��� <br /> ORDINANCE NO.�_ <br /> ORDINANCE VACATING A PORTION OF STREET <br /> - EAST DIVISION STREET - <br /> WHEREAS , a petition has been received from Archer Daniels <br /> Midland Company, the owner of all premises abutting therPon, <br /> requesting vacation by the council of a portion of that said <br /> street in the City of Decatur, Illinois , commonly known as East <br /> Division Street, said portion of said street being more particularly <br /> described as follows : <br /> Commencing at the Southwest corner of Lot 8 of <br /> Race-Land Plat C as per Plat recorded at Book 335 <br /> Page 195 of the Records in the Recorder' s Office <br /> of Pdacon County, Illinois; thence south 40 feet to <br /> the North line of Lot 17 of said Plat C; thence, <br /> east along the North line of Lots 17, 16 ,15 and 14 <br /> of said Plat C 957. 5 feet; thence north 40 fee� to the <br /> South l�ne of Lot 10 oi said Plat C; thence west <br /> 957 . 5 feet along the South lines of Lots 10 , 9 ancl 8 <br /> of said Plat C to the place of beginning; <br /> and, <br /> WHEREAS , the Decatur City Plan Commission held a public hearing <br /> upon said petition on December 7 , 1978 and did thereafter recommend <br /> to the council that the prayer of said petition be granted and said <br /> portion of said street be vacated as requested; and, <br /> WHEREAS , said portion of said street is no longer useful to <br /> the public or to the City or to the owners of property abutting <br /> thereon as a street; and, <br /> WHEREAS , the public interest will be subserved by vacating <br /> said portion of said street and the public will be r�lieved from <br /> any further burden or responsibility for opening, improving or <br /> maintaining said portion of said street. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL QF TH� CITY OF <br /> DECATUR, ;LLINOIS: <br /> Section l. That the above described portion of East Division <br /> Street be , and the same is hereby, vacated as a public street <br /> effective and upon the reservations and conditions hereinafter provided <br /> inasmuch as the same is no longer required for public use and the <br /> public interest will be subserved by such vacation, said portion o� <br /> � said street being shown on the plat thereof hereto attached and hereby <br /> made a part hereof. <br /> i <br />
