� <br /> r� �• ��p�ILHI�D <br /> ORDINANCE N0. �/�=—�—� <br /> ORDINAN CE AUTHORI Z ING RES IDENCE DEVELOPMENT PLAN <br /> - PHEASANT RUN - <br /> WHEREFORE, on the lst day of June, 1978, upon due notice, the <br /> Decatur City Plan Commission held a public hearing upon the petition <br /> of James E. Masey for a special permit under the provisions of Section <br /> XXI C of the Zoning Ordinance for an R-3 Residence Development on <br /> premises situated in the City of Decatur, Illinois , and described as : <br /> Beginning at the Southwest corner of the East Half of the <br /> Northwest Quarter of Section 36 , Township 17 North, Range <br /> 2 East of the 3rd P.M. ; thence North 0°00 ' 00" East along <br /> the West line of said East Half a distance of 765. 40 feet; <br /> thence North 90°00 ' 00" East a distance of 270 . 00 feet; <br /> thence South 0°00 ' 00" East a distance of 490 . 00 feet; <br /> thence North 90° 00 ' 00" East a distance of 430 .00 feet; <br /> thence North 0°00 ' 00" East a distance of 35. 00 feet; thence <br /> North 90°00 ' 00" East a distance of 622 . 02 feet to the East <br /> line of said East Half; thence South 0°03 ' 22" West along said <br /> East line a distance of 274 . 80 feet to the Southeast corner <br /> of said East Half, thence South 88°2?' 25" West along the South <br /> line of said East Half a distance of 1322 . 23 feet to the <br /> point of beginning; and, <br /> WHEREAS, said Decatur City Plan Commission recominended that i <br /> such Residence Development Plan be approved. ', <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That the reconanendation and report of the Decatur I <br /> City Plan Commission be , and the same are hereby, received, placed on I <br /> f ile and approved. <br /> Section 2 . That upon the conditions hereinafter mentioned, <br /> a special permit be, and it is hereby, granted James E. Masey to <br /> develog the premises aforesaid under an R-3 Residence Development Plan <br /> in accordance with the plat and plan thereof hereto attached, marked <br /> Exhibit "A" , and hereby made a part hereof. <br /> Section 3. That said special permit authorized hereby be, and <br /> the same is hereby, expressly conditioned as follows : <br /> (a) That no construction or improvements in or upon said <br /> premises will be commenced until a plat accompanied by plans <br /> and specifications in accordance with the subdivision regulations of <br /> the City of Decatur and conforming otherwise to the conditions <br /> and agreements in this special permit shall be submitted by <br />
