5� <br /> � �� "'l�Ro�r <br /> ORDINANCE NO. . �t,� <br /> u11 <br /> ORDINAI�CE GR.ANTING SPECIAL USE PERMIT <br /> NURSERY SCHOOL <br /> WHEREAS, on the 2nd day of March, 1978 , upon due notice, <br /> the Decatur City Plan Commission held a public hearing upon the <br /> petition of Clarence Ethington and Mary Ethington for a special <br /> use permit to operate a day care center or nursery school in <br /> the City of Decatur, Illinois, on premises described as : <br /> Lot 5 in Blook 2 of William B. Hostetlers Addition <br /> to the City of Decatur, Illinois as per Plat <br /> recorded in Book 802 Page 120 of the records in <br /> the Recorder' s Office of Macon County, Illinois , <br /> commonly known as 3586 MacArthur Road; and, <br /> WHEREAS, said Decatur City Plan Commission did recommend that <br /> the prayer of said petition be granted, and did file a report of <br /> its finding with this Council in support of said recommendation. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF��THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section l. That the findings and recommendations of the <br /> Decatur City Plan Commission be received, placed on file and approved. <br /> Section 2. That upon the conditions hereinafter mentioned, <br /> the Special Use Permit to operate a day care center or nursery school <br /> be, and it is hereby, granted to Clarence Ethington and Mary Ethington <br /> and each of them for the premises aforesaid. <br /> Section 3. That said permit be, and it is hereby,conditioned <br /> as provided in Section XXI. A. (1-6) of the Zoning Ordinance of the <br /> City of Decatur, Illinois,the same being Ordinance No. 3512 , as <br /> amended, and upon the further condition that said premises and the <br /> day care center or nursery school operated thereon be licensed by and <br /> meet all the applicable rules and regulations of the State of Illinois <br /> with regard to such maintenance and operation, and further that said <br /> facility be used only for the care of the number of children permitted <br /> under said rules and regulations not to exceed in number a total of <br /> five (5) children, and further that there be provided on said premises <br /> a fenced-in area of not less than 800 square feet, and further that <br /> should said permittee fail to perform any or all of the aforesaid <br />
