Page 6 - City Plan Commission - March 2, 1978
There were no objectors present.
Staff reconnnendations : We have two Special tise permits for Day
Care Centers on this agenda. This petition has a fenced in yard.
In both instances, the fire marshal has nat yet made his inspection
of the houses. Staff feels there is no particular problem for this
use at this location. Staff would reconunend the approval of the
petition subject to a maximwa of eight children and to a favorable
report from the fire marshal. The fire marshal has standards for
the number of children to be handled, based an the type of ingress
and egress. Staff feels that with this stipulation, they will
not send the matter to Council until a favorable report is made
by the f ire marshal.
There was some discussion regarding square footage requirements
which the fire marshal has and which Children and Fazaily Services
have. The agency has already inspected the house. ,
it was moved and seconded (Cusick/Bassett) and unanimausly passed '
that Cal. No. 78-27 be reconmeended to Council for approval, subject '
to a favorable report from the fire marshal and not more than
eight children to be cared for. i
Cal. No. 78-28 Petition of Clarence and Mary Ethington for I
a Special IIse Permit to oprate a nursery I
school at 3586 MacArthur Rad. I
Petitioners were present but had nathing to add.
Staff recommendations : Mr. Menzies stated that this lot is a large
lot but has no fenced in area. Staff now recoramends that it should
be a recuirement of a day care center to have a fenced in play area.
He indicated staff was going to develop a petition to smend the
or.dinance to require a fenced in area of a crtain size. Staff
recommends approval in this case, subject to the requirer.tents of
not more than five children and a favorable report from the fire
marshal , and also that an area in the rear be fenced in.
It was suggested by the comia.ission that a certain number of square
feet be sgecified for the fenced in yard. . . . .1600 square feet.
It was moved and seconded (Grossman/Wilmeth) and unanimously passed
that this Cal. No. 78-28 be recommended to Council for approval,
subject to the favorable repart of fire marshal, and a stipulation
of a fenced in area not less than 1600 square feet be furnished,
and that no more than five children be cared for.
