r , -. i � • � � �Ot�1.MEd ' ORDINANCE N0. � �� ORDINANCE AMENDING ZONING ORDINANCE - NURSERY SCHOOLS - WHEREAS , on the 6th day of April , 1978 , upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Charles Cherches , Director of the Department of Community Development, to amend the regulations of the Zoning Ordinance per- , taining to nursery schools; and, , WHEREAS, the Decatur City Plan Commission did recommend that I the prayer of said petition be granted and said regulations be so aznended. � NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the recommendations of the Decatur City Plan Commission �e, and the same are hereby, received, placed on file and approved. Section 2. That the Zoning Ordinance, the same being Ordinance No. 3512 of the City of Decatur, as amended, be, and the same is hereby, further amended at Section IX (B) (5_) �thereof, so that as amended said section shall provide as follows : 5. Nursery schools, day care centers, or day care homes accommodating more than three children, when providing on the site a fenced-in outdoor open space, play area having a minimum of 75 square feet per child for the maximum number of children to be served, or 800 square feet, whichever area is larger. Section 3. That said Zoning Ordinance be, and the same is hereby, further amended at Section XXI (A) (k) thereof, so that as so amended said section shall provide as follows : (k) Nursery schools , day care centers , and day care homes accommodating more than three children, or private day or residential schools providing special educational facilities; provided,that on the premises is conveniently located a fenced-in outdoor space play area having a minimum of 75 square feet per child for the maximum number of children to be served or 800 square feet, whichever area is the larger.
