r , -. i <br /> � • � <br /> � �Ot�1.MEd ' <br /> ORDINANCE N0. � ��� <br /> ORDINANCE AMENDING ZONING ORDINANCE <br /> - NURSERY SCHOOLS - <br /> WHEREAS , on the 6th day of April , 1978 , upon due notice, <br /> the Decatur City Plan Commission held a public hearing upon the <br /> petition of Charles Cherches , Director of the Department of Community <br /> Development, to amend the regulations of the Zoning Ordinance per- , <br /> taining to nursery schools; and, , <br /> WHEREAS, the Decatur City Plan Commission did recommend that I <br /> the prayer of said petition be granted and said regulations be so aznended. <br /> � NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the recommendations of the Decatur City Plan <br /> Commission �e, and the same are hereby, received, placed on file and <br /> approved. <br /> Section 2. That the Zoning Ordinance, the same being Ordinance <br /> No. 3512 of the City of Decatur, as amended, be, and the same is <br /> hereby, further amended at Section IX (B) (5_) �thereof, so that <br /> as amended said section shall provide as follows : <br /> 5. Nursery schools, day care centers, or day <br /> care homes accommodating more than three children, <br /> when providing on the site a fenced-in outdoor open <br /> space, play area having a minimum of 75 square feet per <br /> child for the maximum number of children to be served, <br /> or 800 square feet, whichever area is larger. <br /> Section 3. That said Zoning Ordinance be, and the same is <br /> hereby, further amended at Section XXI (A) (k) thereof, so that as <br /> so amended said section shall provide as follows : <br /> (k) Nursery schools , day care centers , and day <br /> care homes accommodating more than three children, or <br /> private day or residential schools providing special <br /> educational facilities; provided,that on the premises is <br /> conveniently located a fenced-in outdoor space play area <br /> having a minimum of 75 square feet per child for the <br /> maximum number of children to be served or 800 square <br /> feet, whichever area is the larger. <br /> Section 4 .
