�, �1 ��0�� ��l��ii�,TVL� !`iV. �'/ - � . . � ORDINANCE GRANTING SPECIAL USE PERMIT :; R-3 NURSERY SCHOOL WHEREAS , on the 5th day of January, 1978, upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Barbara Jones for a special use permit to operate a day care center or nursery school in the City of Decatur, Illinois, on premises described as : The West 50 feet of Lot 61 of Heminger Heights as per Plat recorded in Book 335 Page 513 of the records in the Recorder' s Office of Pdacon County, Illinois ; " commonly known as 3146 East Harrison Avenue; and, WHEREAS , said Decatur City Plan Commission did recommend that the prayer of said petition be granted, and did file a report of its findings with this Council in support of said recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the findings and recommendations of the Decatur City Plan Commission be received, placed on file and approved. r Section 2 . That upon the conditions hereinafter mentioned, the R-3 Special Use Permit to operate a day care center or nursery school be, and it is hereby, granted to Barbara Jones for the premises aforesaid. Section 3. That said permit be, and it is hereby, condition�d as provided in Section XXI. A. l. (1-3) of the Zoning Ordinance of the City of Decatur, Illinois, the same being Ordinance No. 3512 , as amended, and upon the further conditions that said premises and the day care center or nursery school operated thereon be license.d by and _ ' meet all the applicable rules and regul�tions of the State of Illinois with regard to such maintenance and operation, and further that �aid facility be used only for the care of the number of children permitted under said rules and regulations not to exceed in number a total of six (6) children, and further that the backyard of said premises be fenced with a suitable fence at least three (3) feet in height, said fence to be constructed and completed not later than April 30, 1978 , and said fence to enclose, at the minimum, that portion of the above- described premises as shown in Exhibit A attached hereto and hereby made a part hereof.
