AN ORDINANCE REZONING PROPERTY WHEREAS , on the 2nd day of December,� 1976 , upon due notice, the Decatur City Plan Commission held a public hearing upon the � petition of JOHN F. SNYDER to rezone premis2s described as : Lot Eight (8) of Frank Snyder 's Second Subdivision, as per Plat recorded in Book 958, Page 85 of the records of the Recorder' s Office of Macon County, Illinois, EXCEPT a tract � beginning at a point 169 feet West of the Southeast corner of said Lot Eight (8) ; thence West 17I feet; thence North 210 feet; thence East 171 feet; thence South 210 feet to the place of beginning. Also excepting a part of the SW 1/4 , Sec. 35 , T17N, R2E of the 3rd PM, more particularly described as follows : Beginning at a point on the North Right-of-Way line of Pershing Road, 44 . 4 ff.. North of and 170 . 5 ft. East of the SW corner of the SE 1/4 , SW 1/4 , said Section 35; thence N. 1°19 ' 58" E. , 210 ft; thence S. 89°59 ' 58" W. , 189 . 27 feet to the East Right-of-Way line of Broadway Avenue; thence Southerly along said Right-af-Way lin� 117. 56 feet along a curve to the left, having a ra�dius of 5689 .58 feet; thence Southerly 2 . 29 feet along a line tangent to said curve; thence along a curve to the left having a radius of 170 feet, an arc length of 47. 72 feet; thence along a curve to the left having a radius of 55 feet; an arc length of 56 . 31 feet; thence along a curve to the left having a radius of 170 feet, an arc length of 21 .58 feet to the Northerly Right-of-Way line of East Pershing Road; thence N. 90° E. , 123. 7 feet along said Right-of-Way line to the Point of Beginning, containing 38 ,889 sq. ft. , more or less . from R-1 SINGLE FAMILY RESIDENCE DISTRICT to B-2 COMMERCIAL DISTRICT; and, WHEREAS , the Decatur City Plan Commission recommended that the prayer of said petition be granted. NOW, THEREFORE , BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS : Section l. That the recommendation of the Decatur City Plan Commission be, and the same is hereby, received, placed on file and approved.
