' - `M � � /f�� (� �I�CROFlL�ED ORDINANCE NO. �/ 3 O ORDINANCE VACATING EASEMENT LOT 19 , FITZGERALD HEIGHTS FIRST ADDITION WHEREAS, that certain easement \of the City over the South 60 feet of Lot 19 in Fitzgerald Heights First Addition is of insufficient width to include within it the existing surface water drain of the City extending across said Lot; and, WHEREAS, the owner of said Lot has offered to convey to the City a substitute easement for sewer, surface water drainage and other public utility purposes of sufficient width to contain all existing and future utilities including said existing surface water drain in consideration for the vacation of said 60 foot easement; and, WHEREAS , the Council finds it to be in the best interest of the public to vacate said existing easement and to accept dedication of said proposed substitute easement. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the certain existing easement of the City described as follows be,and it is hereby,vacated,the . same being situated in Macon County, Illinois and described as: The South 60 feet of Lot 19 in Fitzgerald Heights First Addition as per Plat recorded at Book 1575 Page 140 of the Records in the Recorder' s Office of Macon County, Illinois. Section 2 . That conveyance and dedication of a substitute easement over said Lot as described in the Grantt3�ereof presented to the Council herewith be, and the same is hereby, accepted. Section 3. That the City Clerk be, and she is hereby, authorized and directed to cause this ordinance and said Grant to be placed of record in the office of said Recorder of Deeds.
