Reoorder of Deeds <br /> WHEREAS, that certain easement of the City over the <br /> South 60 feet of Lot 19 in Fitzgerald Heights First Addition is <br /> of insufficient width to include within it the existing surface <br /> water drain of the City extending across said Lot; and, <br /> WHEREAS, the owner of said Lot has offered to convey to <br /> the City a substitute easement for sewer, surface water drainage <br /> and other public utility purposes of sufficient width to contain <br /> all existing and future utilities including said existing surface , <br /> water drain in consideratic,n for the vacation of said 60 foot . <br /> easement; and, <br /> WHEREAS, the Council finds it to be in the best interest of <br /> the public to vacate said existing easement and to accept dedication <br /> of said proposed substitute easement. <br /> NOW, THEREFOIZE, BE IT ORDAINED BY THE COUNCIL OF THE <br /> CITY OF DECATUR, ILLINOIS: <br /> Section l. That the certain existing easement of the <br /> City described as follows be,and it is hereby,vacated,the <br /> same being situated in Macon County, Illinois and described as: <br /> The South 60 feet of Lot 19 in Fitzgerald <br /> Heights First Addition as per Plat recorded <br /> at Book 1575 Page 140 of the Records in the <br /> Recorder' s Office of Macon County, Illinois. <br /> Section 2. That conveyance and dedication of a <br /> substitute easement over said Lot as described in the Grantthereof <br /> presented to the Council herewith be, and the same is hereby, accepted. <br /> Section 3. That the City Clerk be, and she is hereby, <br /> authorized and directed to cause this ordinance and said Grant <br /> to be placed of record in the office of said Recorder of Deeds. <br /> PRESENTED, PASSED, APPROVED AND RECORDED this 22nd day of <br /> August, 1977. <br /> Elmer W.
