�` . <br /> ', ; . ��q <br /> , - ORDINANCE NO. -/3 � ��T` <br /> ORDINANCE AMENDING R-3 RESIDENCE DEVELOPMENT PLAN <br /> - FITZGERALD HEIGHTS lst ADDITION <br /> WHEREAS, on the 4th day of August, 1977, upon due notice , <br /> the Decatur City Plan Commission held a public hearing upon the <br /> petition of William A. Suter to amend the R-3 Residence Development <br /> Plan approved by Ordinance No. 4974 and subsequently amended by <br /> Ordinance No. 5796 as to premises in the City of Decatur, Illinois, <br /> described� as follows : <br /> Fitzgerald Heights First Addition, as per Plat recorded <br /> in Book 1575, Page 140 of the Records in the Recorder' s <br /> Office o� Macon County, Illinois; and, <br /> WHEREAS, said Decatur City Plan Commission did report its <br /> findings and did recommend that the modification of said R-3 Residence <br /> Development Plan as requested be authorized. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the report and recommendation of the Decatur <br /> City Plan Commission be, and the same is hereby received, placed on <br /> file and approved. <br /> Section 2. That said R-3. Residence Development Plan be, and it <br /> is hereby, amended and that petitioner be, and he is hereby, <br /> authorized to develop lots 19 and 20 in accordance with the <br /> plot plan prepared by Homer L. Chastain & Associates, and dated <br /> August 3, 1977, said plot plan being hereto attached and hereby <br /> made a part hereof and marked Exhibit 1. <br /> Section 3. That except as modified by the provisions hereof, <br /> the heretofore ordained R-3 Residence Development Plan and the pro- <br /> visions of ordinance relating thereto as heretofore amended and modi- <br /> fied remain in full force and effect and the same remain subject to <br /> all the conditions , limitations, and restrictions set out in the <br /> ordinance aforesaid and the respective modifications and amendments � <br /> thereto. <br /> PRESENTED, PASSED, APPROVED AND RECORDED this��/v�day of <br /> , 1977. <br /> MAYO <br /> ATTEST: <br /> : , � . <br /> CITY C ERK <br />
