ORDINANCE N0. 77-110 <br /> AN ORDINANCE VACATING A PORTION OF A STREET <br /> - MERCER STREET - <br /> WHEREAS, a petition has been received from Tyrolt, <br /> Incorporated, and Frank C. Tyrolt and Bernard L. Naber, Partners, <br /> d/b/a Mercer Rentals, the owners of all property abutting the <br /> following described premises, requesting the vacation by the <br /> City of Decatur, of a portion of Mercer Street described a� follows : <br /> Commencing at the Northeast Corner of Lot <br /> Five (5) in Block Two (2) of E. B. Durfee ' s <br /> 2nd Addition, as per Plat recorded in Book <br /> 22 , Page �99 of tYie Records in the Recorder' s <br /> Office of Macon County, Illinois , thence <br /> South to the Southeast Corner of Lot Twelve <br /> (12) in said Addition, thence East to the <br /> Southwest Corner of Lot Eleven (11) in E. B. <br /> Durfee ' s First Addition, as per Plat re- <br /> corded in Book 22 , Page 461 of the Records <br /> in the Recorder' s Office of Macon County, <br /> Illinois, thence North to the Northwest <br /> Corner of Lot Six (6) in said Addition, <br /> thence West to the P.O.B. <br /> and, <br /> WHEREAS, said portion of said street is no longer <br /> useful to the public or to the City or to the owners abutting thereon <br /> as a public street; and, <br /> WHEREAS , the public interest will be subserved by vacating <br /> said portion of said street and the public will be relieved from <br /> any further burden or responsibility for onening, improving, <br /> or maintaining said portion of said street for use as a public <br /> street. <br /> NOW, THERErORE, BE IT ORDAINED BY THE COUNCIL OF THE <br /> CITY OF DECATUR, ILLINOIS: <br /> Section 1. That the above described portion of <br /> Mercer Street be , and the same is hereby, vacated as a public <br /> street inasmuch as the same is no longer required for public use as <br /> a street and the public interest will be subserved by such <br /> vacation and the public will be relieved from any further burden <br /> or responsibility of maintaining the same, said portion of <br /> said street being shown on the plat thereof hereto attached and <br /> hereby made a part hereof. <br />
