'` �" , � ORDINANCE NO. / ��3 ^p��,[VIED ��1N� ORDINANCE GRANTING SPECIAL USE PERMIT NURSERY SCHOOL WHEREAS, on the 7th day of April , 1977, upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of ARDEN GREGORY and SHERLY GREGORY for a special use permit to operate a nursery school in the City of Decatur, Illinois , on premises described as : Lot Eight (8) in Block One (1) of Roy R. Wilson' s First Addition to the City of Decatur, as per plat recorded in Book 536 page 34 of the records in ths Recorder' s Office of Macon County, Illinois , commonly known as 1660 West Riverview; and, WHEREAS, said Decatur City Plan Commission did recommend that the prayer of said petition be granted, and did file a report of its findings with the Council in support of said recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS : Section 1. That the findings and recommendations of the Decatur City Plan Commission be, and the same are hereby, received, placed on file and approved. Section 2. That upon the conditions hereinafter mentioned, the Special Use Permit to operate a nursery school be, and it is hereby, granted to Arden Gregory and Sherly Gregory for the premises aforesaid. Section 3 . That said permit be, and it is hereby, con- ditioned as provided in Section XXI (A) (1) of the Zoning Ordinance of the City of Decatur, Illinois , the same being Ordinance No . 3512 , as amended, and upon the further conditions that said premises and the nursury school operated thereon be licensed by and meet all the applicable rules and regulations of the State of Illinois with regard to such maintenance and operation, and further that said facility be used only for the care of the number of children permitted under said rules and regulations , not to exceed in number a total of six (6) children, and further that no child cared for at said nursery school shall have attained the age of eleven (11) years , and further that should said permittee fail to perform any or all of the aforesaid conditions, this permit shall terminate and be revoked. Section 4. That the District Zoning Map as provided in Ordinance No. 3512 as amended be modified to show the granting of said Special Use Permit.
