�������A��� <br /> �-- <br />'� o�nzN�.vcE No. o�a 5 <br /> AN ORDINANCE GRANTING A VARIATION <br /> WHEREAS, on November 9 , 1976 , pursuant to notice as required by <br /> statute the Decatur Zoning Board of Appeals held a public hearing <br /> upon the petition of WILLIAM E. BOYLE for a variation in the minimum <br /> side yard setback requirements under the Zoning Ordinance of the City <br /> of Decatur from 5 feet to 4 inches upon premises described as : <br /> Lot 7 of Sampson Addition to the City of Decatur, as per Plat <br /> � <br /> recorded in Book 745 a e 251 of the records in the Recorder s <br /> . P g <br /> Office, of Macon County, Illinois; <br /> and, <br /> WHEREAS, after due consideration and upon a vote of less than five <br /> (5) members thereof, said Zoning Board of Appeals did deny the prayer of <br /> said petition and did refuse to vary the �rovisions of said Zoning <br /> Ordinance. <br /> NOW, THEREFORE, BE 2T ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOTS : <br /> Section l. That the decision of the Decatur Zoning Board of Appeals <br /> upon the aforesaid petition be received, placed on file, and disapproved. <br /> Section 2. That the requested variation in the aforesaid minimum <br /> side yard setback requirements from 5 feet to 4 inches as requested by <br /> petitioner be, and the same is hereby, allowed, and the Building Inspector <br /> be, and he is hereby, authorized and directed to issue a building permit, <br /> provided that all other statutes, ordinances, rules and regulations <br />' with regard thereto are properly complied with, permitting construction <br /> of the improvement in said application proposed with minimum setback as <br /> in said application requested and in this ordinance provided. <br /> PRESENTED, ASSED, APPROVED �,ND RECORDED this ��, day of <br /> , 197 � . <br /> ATTEST: MAYOR <br /> . + <br /> � CITY CLERK <br />
