` ! � . .. <br /> �`��W <br /> ORDINANCE NO. ���' <br /> ORDINANCE GRANTING SPECIAL USE PERMIT <br /> R-3 NURSERY SCHOOL <br /> WHEREAS, on the 2nd day of September, 1976 , after notice as re- <br /> quired by law and ordinance, the Decatur City Plan Commission held a <br /> public hearing upon the petition of BONNIE SPALDING for a special use <br /> permit to operate a day care center or nursery school in the City of <br /> Decatur, Illinois, on premises described as : <br /> Lot #2 of Roy McClain' s Addition to the City of <br /> Decatur, Illinois, as per Plat recorded in Book <br /> 982 , page 10 , of the records in the Recorder' s <br /> Office of Macon County. <br /> commonly known as 1181 N. Summit, Decatur, Illinois; and, <br /> WHEREAS, said Decatur City Plan Commission did recommend that the <br /> prayer of said petition be granted, and did file a report of its find- <br /> ings with this Council in support of said recommendation. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS : <br /> Section l. That the findings and recommendations of the Decatur <br /> City Plan Commission be received, placed on file and approved. <br /> Section 2. That upon the conditions hereinafter mentioned, the <br /> R-3 Special Use Permit to operate a day care center or nursery school <br /> be, and it is hereby, granted to Bonnie Spalding for the premises <br /> aforesaid. <br /> Section 3. That said permit be, and it is hereby, conditioned as <br /> provided in Section XXI. A. (1-3) of the Zoning Ordinance of the City <br /> of Decatur, Illinois , the same being Ordinance No. 3512, as amended, <br /> and upon the further conditions that said premises and the day care <br /> center or nursery school operated thereon be licensed by and meet all <br /> the applicable rules and regulations of the State of Illinois with <br /> regard to such maintenance and operation, and further that said facil- <br /> ity be used only for the care of the number of children permitted <br /> under said rules and regulations not to exceed in number a total of <br /> eight (8) children, and further that should said permittee fail to <br /> perform any or all of the aforesaid conditions , this permit shall ter- <br /> minate and be revoked. <br />
