, . }�Q(� ' �A M � �'V"v'�IJHi.1I , eia-- • ORDINANCE N0. � �� AN ORDINANCE VACATING A PORTION OF AN ALLEY WHEREAS , a petition has been received from SOL TICK & CO. , INC. , the owner of all property abutting thereon, requesting the vacation by the City Council of that portion of a certain alley in the City of Decatur, Illinois , described as : Beginning at the Northwest Corner of Lot 134 of Wabash Place, an Addition to the City of Decatur, as per Plat recorded in Book 149 , Page 302 , of the Records in the Recorder' s Office of Macon County, Illinois, thence North 16 feet to the Southwest Corner of Lot 91 of said Wabash Place, thence East 360 feet to the Southeast Corner of Lot 83 of said Wabash Place, thence South 16 feet to the Northeast Corner of Lot 142 of said Wabash Place, thence West 360 feet to the point of beginning. and WHEREAS , said petition was referred to, and a public hearing thereon was held by, the City Plan Commission, which Commission did recommend that the prayer of said petition be granted; and WHEREAS, said portion of said alley is no longer useful to the public or to the City or to the owner of the property abutting thereon as an alley; and WHEREAS , the public interest will be subserved by vacating said por- tion of said alley and the public will be relieved from the further bur- den and responsibility of maintaining the same. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS : Section l. That the above described portion of said alley be, and the same is hereby, vacated as a public alley effective and upon the exceptions and conditions hereinafter provided, inasmuch as the same is no longer required for public use and the public interest will be sub- served by such vacation, said portion of such alley being shown on the plat thereof hereto attached and hereby made a part hereof. Section 2 . That there is hereby reserved in, over, along and under the above described portion of said alley, to the City of Decatur, Illinois , and to the public and to those utilities and companies as the case may be owning public service facilities , mains , sewers, telephone and electrical or other public utilities , such property, rights-of-way and easements as are or may be necessary or desirable for continuing public service by means of such facilities and for the maintenance, renewal, and recon- struction thereof with the right of ingress and egress for such purposes.
