�', ' • �` ' MICROFlLMEp <br /> , , <br /> ORDINANCE NO. � l a� <br /> ORDINANCE ESTABLISHING SALARIES AND <br /> WAGES; ALLOCATING POSITIONS TO PAY <br /> GRADES AND MODIFYING CERTAIN CONDITIONS <br /> OF EMPLOYMENT IN THE CLASSIFIED POLICE <br /> SERVICE <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS : <br /> Section l. That until the further order of the Council and <br /> effective as of and retroactive to May 1, 1976, and subject to the <br /> applicable provisions of existing ordinances, those positions <br /> listed on Exhibit A hereto attached and made a part hereof entitled <br /> Police Service Classified Positions be, and they are hereby, assigned <br /> to the pay grade or range set opposite each thereon and that the <br /> amount of pay for each said grade or range be, and the same is <br /> hereby, established as set out in Exhibit B hereto attached and <br /> made a part hereof entitled City of Decatur Pay Plan Effective as <br /> of May 1, 1976, Police. <br /> Section 2. That, subject to and in accordance with applicable <br /> rules and procedures and to payrolls submitted to and approved by <br /> the Council, employees in the classified police service in positions <br /> below the classified position of police lieutenant, when required to <br /> attend court commencing at a time other than during the regular shift <br /> of such employee shall be paid overtime at time and one-half the <br /> regular rate of pay not less than two and not to exceed six hours <br /> per day for time actually served in court up to said maximum of six <br /> hours , provided that if the regular shift of such employee commences <br /> during the time of such required court attendance, except for said <br /> two-hour minimum, overtime pay shall cease at the commencement of <br /> such regular shift. <br /> Section 3. That it be, and it is hereby, authorized that in <br /> the case of injury, illness or disability arising out of and in the <br /> course of employment with the City, the City will pay the difference <br /> between such employee's regular salary or wages and any payments <br /> received by the employee from a public employee pension fund or under <br /> the provisions of workmen's compensation or occ�zpational disease laws , <br /> or either or both, for the duration of such disability, or a period <br /> of six calendar months from the date of commencment of disability, <br /> whichever is the shorter period of time. The determination of whether <br /> such injury, illness or disability arose out of and in the course of <br /> employment under this provision shall be the same as that made on the <br /> workmen' s compensation or occpuational disease claim of said employee. <br /> Where said injury, illness or disability was caused under circumstances <br /> creating a legal liability for damages on the part of some person or <br /> entity other than the City, then if action is brought by the employee <br /> and judgment is obtained and paid, or settlement is made either with <br /> or without suit, then from the amount received by such employee the <br /> City shall be reimbursed for any and all amounts paid hereunder. Out <br /> of any such reimbursement, the City shall pay its pro rata share of all <br /> costs and reasonably necessary expenses in connection with such <br />
