AAIu ORDINANCE VACATING PORTION OF ALL:Y TN }3I.00F{ 1 Ot� TI� ORIGINAL TOG�7N OF D;?,CATUR tVf-IERLEIS, a petition has been received from Mutual Hoine & Savings Association, the oumer of all propex�ty abutting thereon, requesting the vacation by the City Council of that portion of a certain alley in the City of Decatur, Illinois described as: Cominencing at the Nor�heast Corner of Lot 8 of the Resurvey o£ BZock 1 oi the Original Totvn of Decatur as per Plat recorded in Book 2?, Page 413 ot the Records in the Recorder 's Office of bZacon County, Illinois; thence East 16 feet to the Northwest Corner of Lot 9 of said Resurvey, thence South along the Ldest line of saic3 Lot 9 160 feet to the Southwest Corner or said Lot 9, thence �9est 16 feet to the Southeast Corner oi Lot 27 of said Resurvey, thence North along the East lines of said Lots 27 and 8 to the P.O.B. ; and V�HEREAS, said petition was referred to, and a public hearing thereon was held by, the City Plan Commission, which Commission did recommend that the prayer oS' said petition be gran�ed; and t�i-IEREAS, said portion of said alley is no longer useful to the public or to the City or to the owner of the property abuttinq thereon as an alley; and 6J�IEREA�, the public int�rest will be subserved by vacating said portion of said alley and the public will be relieve� from the further burden and responsibility of maintaining the same: and tVHEREAS, petitioner has offered to provide and maintain in perpet- uity for public use a �y Prom the remainder oS said alley to South tv'ater Street as compensation for the benefits which will accrue to it as the owner of property abutting that portion of said alley proposed to be Vacated. NOVJ, THERLFORE, BE IT ORDAZNED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section l. That the above described portion of said a11ey be and the same is hereby vacated as a public alley or way subject to the exceptions, reservations and conditions herein after set out in as much as the same is no longer required for p�lic use as an alley and the public interest will be subserved by such vacation and the public will be relieved from the .further burden and responsibility of maintaining the same, said portion of said alley being sho�,m on the Plat thereof hereto attached and hereby made a part hereof.
