, M � <br /> _ • \ <br /> . � � � <br /> �'r. \��� <br /> ��. <br /> ���lb <br /> � <br />, � � <br /> � <br /> �� ORDINANCE NO. � U - � <br /> AN ORDINANCE REGULATING ENCROACHMENT ON <br /> PUBLIC RIGHT-OF-WAY IN THE CITY OF DECATUR� <br /> MAO�N COUNTY, ILLINOIS� <br /> WHEREAS, the City of Decatur, Illinois, hereinafter known as <br /> the CITY, and S at toaft ois, acting by and through its <br /> De aYtment of ��x���s���x� <br /> p �, Division of Highways, have <br /> entered into an agreement relative to the improvement of East William <br /> Street Road (FAS 540, SBI 10, II,L. RT. 105, State Sect ion 12R; City <br /> Section 147 C.S. ) from a point 940 feet west of the intersection of <br /> East William Street Road and East E1 dorado Street to approximately the <br /> southeast oorner of Section 9, Township 16 North, Range 3 East of the <br /> 3rd P.M. ; and, <br /> WHEREAS, in order to facilitate said improvement, it is necessary <br /> for the CITY to adopt an ordinance regul ating encroachments on the <br /> right-of-way for said improvement in accordance with the following de- <br /> finition: <br /> Roadway Right-of-Way is define d as those areas existing or ac- <br /> quired by dedication or by fee simple for highv�y purpose s; <br /> also, the areas acquired by temporary easement during the time <br /> the easement is in effect; <br /> Project Right-of-Way is defined as those areas within the pro- <br /> ject right-of-way lines established jointly by the CITY, STATE, <br /> AND Federal Highway Administration �ich will be free of encroach- <br /> ments except as hereinafter defined; <br /> Encroachment is defined as any building, fence, sign, or any other <br /> structure or object of any kind (with the exception of utilities <br /> and public road signs ), which is placed, located or maintained in, <br /> on, under or over any portion of the project right-of-way or the <br /> roadway right-of-way where no p roject right-of-way line has been <br /> established; <br /> Pexmissible Encroachment is defined as any existing awning, mar- <br /> quee, advertising sign or similar overhanging structure supported <br /> from a building i�ediately adjacent to the limits of the platted <br /> street where there is a sidewalk extending to the building line <br /> and which does not impair the free and safe flow of traffic on the <br /> highway; the permissive retention of overhanging signs is not to be <br /> construed as being applicable to those signs supported from poles <br /> constructed outside the project right-of-way line and not confine d <br /> by adjacent buildings; <br />
