HEISE and <br /> CA�20LINE HEISE, owners of the land encumbered thereby, requesting <br /> vacation of flood right easement owned by the City of Decatur, Illinois, <br /> over Iand in the City described as: <br /> Commencing at a point on the South line of Sectio n <br /> 24, T. 16 N, R. 2 E. of the 3rd P.M. , 1142 feet <br /> West of the Southeast corner of said Section 24; <br /> thence N. 28 degrees, 34 minutes East 34.16 feet, <br /> more or less, to the point of beginning on the <br /> North right-of-v+ray line of Lost Bridge Road; thence <br /> N. 28 degrees, 34 minutes East, 30.34 feet; thence <br /> N. 48 degrees, 43 minutes West 216.14 feet, more or <br /> less, to a point that is 60 feet dis tant at right <br /> angles Easterly from the property line of Decatur <br /> Water Supply Company and the City of Decatur; thence <br /> Sout h 5 degrees, 27 minutes West, 170.02 feet, more <br /> or less, to a point on the said North right-of-way <br /> line of Lost Bridge Road; thence East 164.06 feet, <br /> more or less, to the point of beginning, and contain- <br /> ing 0.39 acres, more or less; <br /> and; <br /> WHEREAS, said City Plan Commission has recommended that <br /> the p�rayer of said petition be granted and said easement be vacated; <br /> an d, <br /> WHEREAS, since said easement was acquired by the City more <br /> than fifty years ago, the topography of the surrounding lands has been ; <br /> changed and various drainage structures and streets have bee1; oY are <br /> in the process of being, constructed so that the necessity for and use- <br /> fulness of said easement has ceased; and, <br /> WHEREAS, said easement is no longer useful to or needed for <br /> a public purpose by the public and it is on the other hand an encum- <br /> brance upon the land owned by petitioners. <br />
