Itettis 8-13 of Sections 4 and 5 of the above Terms and Conditions of ITEL Lease Agree- <br /> ment are inapplicable to/the above Machine Schedule since the machine or <br /> machines set forth in said hiachine Schedule are not manufactured by IBM. . <br /> Therefore, said sections are hereby deleted with respect to the above Machine <br /> Schedule and the following is hereby added to repiace said sections: <br /> 4. Commencement Date. <br /> Customer shall use its best efforts to install each machine as soon as possible . <br /> . after delivery thereof. The Commencement Date of any Machine Schedule or <br /> Schedules sha11 be the date upon w}iich all the machines listed on any such <br /> Machine Schedule subject hereto are installed, ready for use; provided, however, ' <br /> ;Ehat m�cll�te�s and eonditions�of�this Agrecment�shall ap�}�,�and Gustamer s�tall <br /> pay to ITEL the monthly Availability Charge specified on the applicable Machine <br /> Schedule for any machines listed on any such Machine Schedule and any unit, <br /> feature, or element thereof subject thereto beginning on the date of installation <br /> of such machine but no later than the date that such equipment on any such <br /> Machine Schedule is available for delivery to Customer's location pursuant to ' <br /> the shipping schedule mutually agreed upon plus the number of days actually <br /> required to install such machine. <br /> S. Maintenance. � <br /> ITEL, or its designated representative, will keep the machines in good <br /> working order and will make all necessary adjustments or repairs to the machines <br /> with maintenance personnel available on a seven (7) day per �veek, twenty-four <br /> (24} hour per day, basis. For this purpose ITEL, or such representative, shall <br /> have full and free access to the machines. Charges for installation and dismantling <br /> shall be borne by Customer, and Customer agrees promptly to reimburse ITEL for <br /> any amounc thereof paid by ITEL <br /> A suitable place of installation with all facilities as specified by ITEL or its <br /> designated representative will be furnished by the Ciastomer. Such facilities shall <br /> meet at all times the minimal standard of the National Board of Fire Under�vriters <br /> for protection of Electronic Computer Systems as recommended by the National <br /> Fire Protection Association. Customer will be responsible for assuring the proper <br /> use, management and supervision of the machines. Customer agrees that ITEL <br /> �vill not be liable for any damages caused by Customer's failure to fulfill any of <br /> Customer's responsibilities hereunder. <br /> M DG:58 1/i/12 <br />
